These Terms of Service ("Terms") govern your use of the KUHA mobile application and related websites (collectively, the "Service"), operated by HNS Corp. ("HNS Corp.", "we", "us"). By downloading, installing, or using KUHA, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
By creating an event, joining an event, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
- You must be at least 13 years old to use KUHA as a guest.
- You must be at least 18 years old to create and host an event.
- You must have the legal capacity to enter into a binding contract in your jurisdiction.
- You may not use KUHA if you are barred from receiving services under the laws of the Philippines or any other applicable jurisdiction.
3. Your account
Hosts may create a recurring account secured by a 4-digit PIN and an email address. You are responsible for keeping your PIN confidential and for all activity that occurs under your account. Notify us at hnscorpph@gmail.com if you suspect unauthorized access.
Guests join events without creating an account; their identity within an event is the display name they provide on entry.
4. Pricing, payment, and refunds
KUHA is a paid service. To create and activate an event, the host pays a one-time fee corresponding to the chosen tier:
- Barkada — ₱249 per event, up to 20 guests
- Party — ₱699 per event, up to 60 guests
- Wedding — ₱999 per event, up to 200 guests
- Corporate — ₱2,999 per event, up to 500 guests
Prices are in Philippine Pesos (PHP) and are inclusive of any applicable taxes unless stated otherwise. We accept payment via GCash, Maya, GrabPay, and major debit/credit cards through our processor PayMongo. We do not store full card numbers on our servers.
Event activation: events remain in a pending_payment state and cannot accept guest joins or photo uploads until the host's payment has been confirmed. Unpaid events automatically expire 24 hours after creation.
Refund policy: KUHA delivers a digital service that begins as soon as the event is activated. We will issue a full refund if all of the following are true:
- You request the refund within 7 days of payment, by emailing hnscorpph@gmail.com with your event code;
- Fewer than 3 guests have joined the event;
- Fewer than 10 photos total have been uploaded to the event.
Outside of these conditions, refunds are at our sole discretion and may be partial. We do not refund completed events, closed events, or events with significant guest activity. Chargebacks initiated without first contacting our support team may result in account termination.
All payments are final once an event is closed. Storage of an event's photos is included for one (1) year from the date of payment unless extended via a paid add-on.
5. Acceptable use
You agree not to use KUHA to:
- Take, upload, or share content that is unlawful, threatening, defamatory, obscene, sexually explicit involving minors, or that incites violence.
- Capture or share images of anyone in a setting where they have a reasonable expectation of privacy (e.g., bathrooms, dressing rooms).
- Harass, bully, or intimidate any other user or any person depicted in a photo.
- Infringe any third party's intellectual property, privacy, publicity, or other rights.
- Attempt to bypass shot limits, time locks, or moderation; reverse-engineer the app; or interfere with its security.
- Use the Service for commercial photography services, paid advertising, or to collect data on attendees.
- Scrape, crawl, or use automated means to access the Service.
We may remove content and suspend or terminate accounts that violate these rules, in our reasonable discretion.
6. Your content
Photos and other content you upload remain yours. You retain all ownership rights.
By uploading content to KUHA, you grant HNS Corp. a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and adapt that content solely for the purpose of operating the Service — for example, applying film effects, transcoding, and showing your photo to other guests of the same event.
This license ends when the content is deleted from the Service (whether by you, the host, or through retention expiry). We do not use your photos to train machine-learning models, and we do not sell or sublicense your photos.
You represent and warrant that (a) you have the rights necessary to upload the content; and (b) the content does not violate the rights of any third party or any law.
7. Hosts & guests
Hosts choose the rules of their event: name, shots-per-guest, and reveal mode. Hosts can see all photos in their event regardless of reveal state and can delete any photo. By joining an event, you accept the host's settings.
Hosts are independently responsible for their events, including ensuring that participants consent to being photographed where required by law. KUHA is a tool — it does not endorse, sponsor, or take responsibility for the content of any particular event.
8. The disposable rule
KUHA is intentionally designed around scarcity:
- Once you've used your shots for an event, you cannot take more.
- You cannot delete your own photos once taken; only the host can delete from their event.
- Delayed reveals cannot be unlocked early by guests.
These are product features, not bugs. By using KUHA, you accept these constraints.
9. Our intellectual property
The KUHA name, wordmark, logo, app design, source code, and the look and feel of the Service are owned by HNS Corp. and are protected by Philippine and international intellectual-property laws. Nothing in these Terms grants you any right to use our trademarks or trade dress without our prior written permission.
10. Third-party services
The Service relies on third-party providers (e.g., cloud hosting, email delivery, crash reporting). Their use of your data is governed by our Privacy Policy and their own terms.
11. Termination
You may stop using KUHA at any time. You can delete your host account through the in-app settings or via delete-account.html.
We may suspend or terminate your access if we believe in good faith that you have violated these Terms, that your use threatens the safety or rights of others, or that we are required by law to do so. Where reasonable, we will notify you and give you an opportunity to remedy.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA, INCLUDING PHOTOS, WILL ALWAYS BE PRESERVED. KEEP YOUR OWN COPIES OF ANYTHING IMPORTANT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HNS CORP. AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) PHP 5,000.
14. Governing law & disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising under these Terms is the courts of Metro Manila, Philippines. Nothing in these Terms limits any mandatory rights you have under applicable consumer-protection law.
15. Changes to these Terms
We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify hosts by email or in-app notice. Continued use of the Service after a change takes effect constitutes acceptance of the new Terms.
